I think Regina wanting Emma to take the twins away was part of her power plays against Emma? She'd just been voted Sheriff--another level of permanence to her being in Storybrooke--and there's an element of Regina punishing her/making her not want the job after all?
She had Sidney dig up all that dirt on Emma so had to know she'd be horrified at putting the kids into a state foster home. (Also, perhaps a subtle reminder of what could have happened to Henry if Regina hadn't adopted him? Surely Emma wouldn't have wanted that for him, etc).
It also makes me wonder if children are exempt from the curse, but as they don't age they never get old enough to be allowed to leave on their own? I know Regina IS evil and that is rooted in bb!Snow as we now know, but I can't see her outright not caring if children die, not with her over-attachment to Henry and attempts to have those kids stay with her, etc. She clearly craves a family and it doesn't fit that she would harm them.
Also, I know the show didn't go with that opening, but in Hansel and Gretl they're left in the woods because their parents can no longer afford to feed them (surprised the show didn't go that dark, tbh). So the dad of the year schtick with not!Krycek isn't set in stone for me.
